The Constitutional Case For Legal Sports Betting

The Federal ban on sports betting has been blasted by anyone who knows anything about the subject for a number of different reasons. Though the US professional leagues suggest that sports betting threatens the integrity of their games, the opposite is the case. The professional bookmaking industry is usually where any type of compromised or fixed game is discovered. Ultimately, the best case for legal sports betting is Constitutional.

The Congress of the United States has shown very little respect for the Constitution in recent years. Were it to abide strictly by the role outlined for it by the founding fathers, the Legislative Branch of our government would have to relinquish any number of its powers in a variety of areas. The primary problem with our Congress is that it has increasingly become a collection of career politicians rather than a body representative of its constituency. Every increase in power at the Federal level must be brought about by a usurpation of state and local sovereignty and, more alarmingly, personal liberty.

The Federal prohibition of sports wagering which was enacted a few years back is of very dubious Constitutionality. Were it not for the grandfather clause, which allowed it to remain legal in jurisdictions in which it already existed, it would have certainly been struck down as unconstitutional on a number of different fronts.

Unfortunately, the mere fact that a proposed law or initiative is unconstitutional offers little protection for the citizenry. In fact one of the most important concepts in the Constitution"that of the right to sovereignty and self-determination of the individual states"is one of the most frequently abused. For those of you not up on the Constitution (and if youre not, you certainly should be), lets consider the 10th Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The overriding concern of the writers and framers of the Constitution was that the personal liberty of the individual not be violated by a too-powerful central government. In other words, unless the power in question has been expressly given to the Federal government by the Constitution, and/or unless it has expressly been prohibited to the states (as in the case of treaty making) it is the right of each individual state to govern themselves as they see fit. If an individual state chooses not to regulate a certain activity, it is the right of each individual citizen to make their own decision.

So, you should be asking yourself at this point, where exactly does the Constitution delegate to the Federal government the right to make policy on sports gambling? The answer is that it doesnt, and it is very questionable that they have the Constitutional authority to do so. Fortunately for all freedom loving Americans the founding fathers would beg to differ.

Sports gambling may seem a minimally important issue to some, but the erosion of liberty is an incremental danger. The danger to broader concepts of personal liberty may seem a million miles away, but with each additional law intended to protect us from this or that the Federal government becomes larger and more powerful and the rights of the sovereign states"and the individuals that comprise them"are shrinking and being weakened.

Darwin's proposed Theory of Evolution, was an attempt to explain the development of species. The idea of natural selection, that the strong survive and the weak die off, has been integrated into the modern understanding of biology, but the organic world is not the only place where this survival of the fittest takes place. Quite the contrary: natural selection dominates the online business realm as well. However, while circumventing biology can be nearly impossible, utilizing the online marketplace to stay on top does not have to be as difficult.

The understanding of how to survive is the key. While companies around the world launch websites, only a select few make it to the big time. These company websites receive millions of hits and show up front and center on major search engines. In fact, being featured on the front page of a Google search results list is the best way to stay ahead of electronic natural selection. That task, however, is easier said than done.

Internet searches traditionally have displayed results through a ranking system. This system worked by examining the content of the page and rating its overall relevance to the search being performed. The search engine would then present the designated sites by their rank. Investor Mind Control: Is It For Real?

Discovering the 'thumbscrews' of investors is crucial to getting them to take action. In over a decade of dealing with global investors there are several elements that I've discovered to be universal truths about the mind of the private investor (angel investor, accredited investor).

When talking to an investor for the first time, it's more important to listen than to speak. It's more important to ask questions than answer them. It's more important to discover their needs and wants than to exclaim your own. Your first conversation with an investor should be all about piercing the armor and finding the trigger points that prompt a reaction that gets to the center of their 'childlike' state.

What I mean by this is, investors, just like anyone else, has insecurities that are rooted in their childhood and what they are outwardly today, is typically a polar opposite of what they are on the inside. For example, an arrogant, chest beater seems proud and obnoxious on the outside but the reality is that they are over compensating for an insecurity that is rooted in an individual or collection of childhood incidents.

Maybe they were made fun of as a child, maybe they're father was verbally abusive, maybe their teachers would single them out in class opening them up to playground mockery. When talking to these individuals it's important to listen to their voice and intonation when the conversation topic changes. Take notes on their psychological adjustments to the conversation. After you feel you have discovered the triggers that induce the 'pleasurable' responses, end the call, and set your second phone appointment with them.

On that second call, you want to have your conversation ready to go using the triggers you found in the first conversation. Play off of those insecurities that you found, become their best friend without being chummy but it is your mission on this call to be the "guy that understand me" to the investor. You want the overall tone of this conversation to have the response from your target along the theme of, "wow, this guy gets me" , "I can see investing in this company".

By using this method and not coming across as 'fake', you have become an investment opportunity and a shrink all rolled into one. You want to be the one person that this investor can lower his guard to because everything he says, you seem to be the one person who understands him at his deepest level. You seem to naturally be tuned into his insecurities, emotions, needs and wants. Sound strange? Try this out on the next investor you talk to, I guaranty you will be shocked with the results.

Three Effective Brochure Design Tips

Have you ever considered that a booklet can be one of the most compelling of all your selling materials?

It is a simple piece of paper but the initial impact that your booklet produces is important. If it's shabby and unpresentable your prospect is left with the same opinion. This will slow your business growth.

Having a leaflet professionally designed and published is a key to winning in a packed marketplace. Taking the time to make sure that your pamphlet delivers all the key information in a way that is easily figured is something that only a professional can do.

If you are just starting out in business you may be tempted to do your brochure yourself. When I first started in business I did everything myself - not a good choice. That is why it took me 12 years before I was even relatively prosperous. Heed my warning - go professional from day one on your marketing materials. They are an investment and not an expense. Professionally created materials will deliver you customers and the cash flow to follow - the reason why you are in business.

A brochure has to use eye-catching design. It has to be brief in terms of the content and last but not the least, it must be successful in enticing people to make that call of action.

Here are three key design principles to follow when making a leaflet. Use them and you will see your results flow.

1. The cover:

The cover is your sales rep. Booklets are quite inactive creatures and you are not often able to 'walk' individuals through your brochure. So you need to arouse people to read further. The cover is the starting point so must be tantalising and sharing the KEY values of WHY someone should read further. It should answer the WIFM question - What's in it for me.

A great design company will show you at least three to four cover designs for your pamphlet. Analyse these designs to examine which excites you the most. Ask your acquaintances their opinion. Does the cover answer the question WIFM? If it doesn't energize and answer the WIFM question, then skip to another design that works or get it redesigned. Taking the time here to get it right will pay bounties later.

2. The Content:

Once they are past the cover then the content has to become the sales rep. So once again, the pressure is on to be great. Do not opt for cheap incompetent content writers or ask the designer to write the content or worst still do it yourself. Instead make sure that a professional copywriter is doing the work. If your design company does not have a copywriter then employ one yourself.

Check Out that all the key questions that a future customer will have about your product are answered in a way that gets them to call you for more information. Do not go into 'overkill mode' and deluge them with too much data at this point in time. Remember the brochure's job is to stimulate and get people to call you.

3. The call for action:

If your prospective customer has read the leaflet then you have done a great job. All you need to do now is give them a compelling reason to contact you NOW.

Having things like a free call 0800 or'00 number clearly shown (in big letters) can make a huge difference. Having an email address is a clear bonus. Make sure these two are distinctly placed in large clear type.

Even give your clients a special coupon on the brochure or reference code can help. But above all, make sure that you add a clear call to action. One way to do this is to readdress the KEY value of your service to your prospect in a way that will get them to take action. Remember value is everything. People only buy something that is of value to THEM.

4. The part that got missed:

I did this on purpose and only said there were 3 points. Well the final point is the one that can get omitted. It is the 'dummy' one. Have you checked that you have these on your leaflet:

Phone number | Fax number | Email address | Web address | Country of operation | City / area of operation | Company name | And have you proof read for typo and grammar errors?

Redskins Offense A Mess Under New Play Caller Lewis

The Washington Redskins are a mess right now. Head coach Jim Zorn has a tenuous hold on his job at best and after Sunday's---6 loss to Kansas City was stripped of his offensive play calling duties. Management installed newly hired 'offensive consultant' Sherman Lewis as the new offensive play caller and the team has set up an awkward arrangement for him to get the plays to the quarterbacks. For that reason, starting QB Jason Campbell has some serious misgivings about the efficacy of the setup.

Lewis has only been out of retirement and with the team for two weeks, and has spent this week trying to ingest a crash course on the Redskins' offensive schemes. While he was learning on the job, head coach Zorn was trying to put the best spin possible on what can only be seen as a de facto demotion and vote of 'no confidence':

"I need to have composure. I need to understand what the reality of the situation is, and I think our players expect me to rise up. We expect them to play under adverse conditions. We expect them to risk it all. ... I'm conscious of what's going on. I'm not naive about what's going on, and yet I have to just hold back on any feelings and make the decisions."

Quarterback Campbell is more concerned about the convoluted system of getting plays from Lewis to him:

"There'll probably be a couple of plays I have in my head just in case if some reason it doesn't get in on time."

Here's how things are supposed to work-Lewis will sit in the coaches' box above the field and read the plays off a sheet. While Lewis has years of experience working in the so called 'West Coast Offense', Zorn left doubt that he really knows what he's doing at this point stressing that Lewis "doesn't know the protections" and "doesn't know the blitz schemes." Nevertheless, he'll be running the offense when the Redskins take on Philadelphia this Monday night.

Once Lewis figures out what to call, that's when it really gets tricky. He'll relay the plays via headset not to Zorn but to offensive coordinator Sherman Smith. Smith will then inform the quarterback what to run. Zorn is left in the role of a passive bystander on offense, though he will listen in to the playcalling on his headset.

Backup quarterback Todd Collins also shared his concern with the new arrangement:

"It is unsettling. I've never gone through this before. I've never had a play caller get changed in the middle of the season."

Lewis didn't exactly evoke a lot of confidence upon his hiring, where he revealed that he'd been calling bingo games at a seniors' center to kill time since his retirement in 2004. Still, Collins gave him a guarded vote of confidence;

"I know he's been studying last year's game against the Eagles and seems to have a pretty good idea how he wants to call the game this week. It's the same plays. He might coach them a little differently or highlight some different areas, but the offense hasn't gone under an overhaul or anything like that."

The Redskins haven't scored more than 17 points in a game this season, so maybe the thinking is that things can't get any worse.
